WAIVER AND RELEASE. You (the Buyer and Enrollee) agree that you are aware that you are engaging in a physical exercise, training and instruction, which could cause injury to you. You are voluntarily participating in these activities and assume all risks of injury to you that might result. You hereby waive any claims or rights you might otherwise have to sue the Center, its employees or agents for injury to you on account of these activities. You have carefully read this waiver and release and fully understand it is a release of liability. You further agree to release the Center from any liability for any loss or theft of personal property. The Center will make no evaluation or recommendation whether Enrollee or guest are sufficiently physically fit for any exercise activities. It is always advisable to consult your physician before undertaking a physical exercise program.

This contract constitutes the entire and exclusive agreement between the parties. Any promises, representation, understandings and/or agreements pertaining directly or indirectly to this contract which are not contained herein, are hereby waived. This Contract may be modified only by an instrument in writing; however, the Center or assignee of the Contract is hereby authorized to correct patent errors in the Contract. The contract may not be enlarged, modified, or altered except in writing, signed by both parties. No oral changes are binding.

The contract will be governed by the laws of the State of North Carolina and of the United States. If any part of the contract is held invalid, the invalidity shall not affect the remaining provisions hereof.

The Center can delay or refrain from enforcing any of its rights under this contract without losing them. For example, the Center can extend the time for making some payments without extending others.
